Investor together with the spouse/partner must have total net business and personal assets of at leastAUD 1,25 million (USD$ 803,000)

Other Requirements

  • At least 65 points during the test;
  • Submit evidence showcasing the success of your business (including annual turnover and ownership stake);
  • Genuine aspiration to possess and oversee a business in Australia
  • Possess business(es) with an annual turnover of a minimum of AUD 750,000 for two out of the four financial years preceding the application.

INVESTOR STREAM VISA (subclass 188)

Investment of at leastAUD 2,5 million (USD$ 1,6 million)

The investment of AUD 2.5 million must be allocated as follows:

  • At least AUD 500,000 in venture capital and growth private equity funds targeting start-ups and small private companies.
  • At least AUD 750,000 in approved managed funds focusing on emerging companies listed on the Australian Stock Exchange.
  • A ‘balancing investment’ of at least AUD 1.25 million in managed funds
Other Requirements
  • At least 65 points during the test;
  • Experience of at least three years;
  • Possession of net assets totaling at least AUD 2.5 million, owned by the applicant and/or spouse, in the two fiscal years leading up to the application date, supported by appropriate documentation
  • Investment must be maintained for at least five (5) years. If withdrawn, visa will be annulled.

Significant Investor Stream - SIV (subclass 188)

Investment of at leastAUD 5 million (USD$ 3,2 million)

The investment of AUD 5 million must be allocated as follows:

  • At least AUD 1 million in venture capital and growth private equity funds targeting start-ups and small private companies.
  • At least AUD 1,5 million in approved managed funds focusing on emerging companies listed on the Australian Stock Exchange.
  • A ‘balancing investment’ of at least AUD 2,5 million in managed funds
Other Requirements
  • Commitment to retaining the investment throughout the visa duration;
  • Residing in the State or Territory where the investor had been nominated;

Application Process

Bayat Legal Services’ compliance team will conduct an internal due diligence check, which entails a background security screening of the applicant, Preparation of KYC (Know Your Client) and a qualification assessment.
Bayat Legal Services will meticulously analyze the client's case. Once this is done, the client will proceed to sign a retainer agreement with the firm. Subsequently, Bayat Group will curate filing forms. Submission of an Expression of Interest (EOI) letter must be done through "Skill Select" platform to attain nomination from a State or Territory Government.
All required documents must be scanned in color, however, there is no need to certify them, but non-English documents must have the accredited translation.
All applications for Australian residency must be filed through the online portal developed by the Department of Home Affairs, Immigration and Citizenship division. Once nomination is attained and an invitation to apply is received, applicants are required to submit their online visa application within 60 calendar days. (www.immi.homeaffairs.gov.au/
The applicant will be provided with a written notification of the visa decision. In case of approval, the applicant will receive details regarding the visa grant number, its commencement date, and associated terms. Should the visa application be denied, the applicant will be duly notified of the grounds for refusal and their entitlement to request a review of the decision. The application fee will not be reimbursed, in case of denial.
After receiving visa application approval, the investor will be instructed on the complying investment timing. Once the investment is made, the temporary visa is granted for up to five (5) years (extendable to 9 years) with a mandatory minimum physical residency in Australia.
