Overview

The US EB-5 Investor Visa program offers foreign investors and their immediate family members the opportunity to attain permanent residency, so-called ‘Green Cards.’ This can be achieved by making qualified investments in approved commercial enterprises and generating jobs in the USA.

The program is operational since 1990. It does not require any business experience, minimum skills or education. Although, a physical residing in the USA of the main applicant for at least 6 months per year is required to maintain the visa.

The EB-5 investor visa program has a minimum investment requirement of US$ 800,000 if the investment is made in a Targeted Employment Area (TEA) and US$ 1.05 million for a standard investment (outside TEA). Family members of investors are also eligible to apply for and obtain ‘Green Cards.’ After holding permanent residency for five years, it becomes possible to apply for citizenship.

Investment Options

There are two investment routes that render foreign investors eligible for an EB-5 Visa:
Targeted Employment Area (TEA), which includes rural regions or areas with high unemployment rates US$ 800,000
Outside TEA US$ 1,05 million
Investment must create at least ten (10) jobs and investors need to actively manage the day-to-day activities and/or policy formulation of the enterprise.
Investment can be performed either directly or through Regional Centers.
Regional Centers offer investment opportunities that have been preapproved by the U.S. Citizenship and Immigration Services (USCIS). There are more than 640 registered Regional Centers in the USA.

Application Process

Bayat Legal Services’ compliance team will conduct an internal due diligence check, which entails a background security screening of the applicant, Preparation of KYC (Know Your Client) and a qualification assessment.
After signing a retainer agreement with Bayat Group, applicants should proceed to collect needed documents.
Once the right EB-5 project or Regional Center is selected, funds for qualified investment be transferred into an escrow account. Bayat Group’s skilled immigration attorneys will submit the initial application, known as the I-526 petition, to the USCIS.
Upon approval of the I-526 petition, Bayat Group initiates the documentation process for a two-year Conditional Green Card. In case of I-526 petition denial, investment funds are refunded in compliance with the Regional Center partnership agreement's stipulations.
Investors need to travel to the US and file an I-485 petition for a Conditional Green Card. The petition processing time is around 6 months.
After two (2) years, investors become eligible to attain permanent residency in USA. The I-829 petition must be filed to the USCIS to remove restrictions on obtaining permanent residency.
